These Terms of Use ("Terms") govern your access to and use of service from Horizon Global ("Fever Collective", "we", "us"), including this website and any purchase you make through it (together, the "Services"). By using the Services you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and age

The Services are intended solely for adults. You may use them only if you are at least 18 years old, or older where your jurisdiction sets a higher age of majority for purchasing adult products. By using the Services you represent that you meet this requirement and that adult products may lawfully be sold to you where you live.

We may refuse or cancel any order where we reasonably believe this is not the case.

2. Accounts

You can order without an account. If you create one, you are responsible for the accuracy of your details and for keeping your password confidential, and for activity that occurs under your account. Tell us promptly at Support@FeverCollective.com if you believe it has been used without your permission.

3. Products, pricing and availability

Our products are limited-run items produced in partnership with the creators they are modelled on. Availability is not guaranteed, and we may limit quantities per customer or per order.

Prices are shown in USD by default and exclude taxes, duties and shipping unless stated. We try to describe products accurately, but colour, finish and minor dimensional variation are inherent to the casting process and are not defects.

If a product is listed at a materially incorrect price due to an error, we may cancel the order and refund you in full rather than fulfil it. We will tell you before doing so.

4. Orders and payment

Your order is an offer to buy. A contract forms when we send an order confirmation, or when the item ships, whichever is stated in that confirmation. Payment is processed by a third-party payment provider; we do not store full card details on our systems.

Your billing statement will show a discreet descriptor rather than the store name.

5. Final sale and hygiene

For health and hygiene reasons, intimate products are final sale once the packaging is opened. If your product arrives damaged or defective, please contact us within 30 days to request a replacement. For any questions about returns, we recommend reaching out to us at Support@FeverCollective.com before sending any products back. Full detail, including damaged and incorrect items, is in our Shipping & Returns policy, which forms part of these Terms.

6. Intellectual property and creator likeness

All content on the Services — text, imagery, design, and the products themselves — is owned by us or by our creator partners and licensors, and is protected by intellectual property and personality/likeness rights.

Each product is produced under licence from the creator it depicts, with their documented consent. You receive ownership of the physical item you purchase. You receive no licence to reproduce, cast, mould, scan, manufacture, resell commercially, or otherwise exploit the item, the creator's likeness, or our branding.

7. Acceptable use

You agree not to: use the Services unlawfully or for anyone under 18; resell our products commercially without written permission; reverse-engineer, copy or reproduce products; misrepresent your identity, age or location; interfere with the security or operation of the Services; or scrape or harvest data from them.

8. Disclaimers

The Services and products are provided "as is" to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted or error-free.

Our products are novelty adult items. They are not medical devices and make no therapeutic claim. Use them as directed in the enclosed care guide, with a compatible lubricant, and discontinue use if irritation occurs. You are responsible for using them safely and hygienically.

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or your statutory consumer rights.

9. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue or data. Our total liability arising from any order is limited to the amount you paid for that order.

10. Indemnity

You agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of these Terms or your misuse of the Services or products.

11. Termination

We may suspend or terminate your access if you breach these Terms or if we reasonably suspect fraud or unlawful use. Sections that by their nature should survive termination will do so.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of California, except where mandatory consumer law in your country of residence gives you the right to bring proceedings locally.

15. Changes

We may update these Terms. The "Last updated" date above shows when. Material changes will be notified on the Services. Continued use after a change means you accept the updated Terms.
